DefinitionsIn this document the following words shall have the following meanings:
"Buyer" means the person who buys Goods from the Seller;
"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
"Goods" means the articles that the Buyer agrees to buy from the Seller;
"List Price" means the list of prices of the Goods maintained by the Seller as amended from time to time;
"Seller" means Celtic Intuition Limited (CIL) of 42 Trehurst Street, London, E5 0EB.
"Terms and Conditions" means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the Seller. |
Copyright, Commercial Confidentiality and PrivacyThe Buyer undertakes to ensure that they have copyright on the images sent for scanning. Celtic Intuition Limited has no rights to any of the images it processes.
To ensure privacy and safeguard media, all media are kept in locked storage and (maximum) 7 days after processing and shipping, scans are automatically removed from our systems. For this reason, it is essential you inform us as early as possible of any failure to receive your scans as up to that point we can burn a replacement disc.
Celtic Intuition Limited will not display your images on our site or release them or any details of them to third parties. We treat all images as private and with discretion whether commercial or personal.

Governing Law and JurisdictionThese Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts. |
GeneralThese Terms and Conditions shall apply to the exclusion of any other Terms and Conditions, unless an agreement is in writing and signed by a representative of CIL and the Customer.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by CIL ( the Seller ). CIL may choose not to accept an order for any reason.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions.
Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer.

Conditions of scanningAll scanner loading, border and rotation work is done by hand, as such CIL shall endeavour to minimise image area loss and ensure correct image orientation, but we can provide no guarantee of this.
Unfortunately black and white film is opaque to the infra red digital cleanup mechanism used in our scanners and therefore we cannot provide the digital cleanup service for black and whte negatives. Monochrome negative and slide scans are therefore supplied without digital cleanup.
Additionally some older emulsions may give a strong colour cast on the scanned image. Where possible we will try to reduce this in the scanned image.
We reserve the right not to scan a slide or negative strip if it is in such a poor condition that either the slide, negative or our scanning equipment would be put at risk of damage. We are sorry, but we cannot undertake repair work on slides or negatives.
All 35mm negatives must have standard sprocket holes to be scanned in our equipment. That is, multiple close spaced sprocket holes running down both sides of the negative.

Pricing and PaymentAll prices quoted on CIL's website are in British Pounds Sterling. Delivery charges are calculated on the basis of weight and Buyer chosen cover and delivery options.
The price for negative and slide scans is per negative and per slide. The price of the Goods shall be that stipulated on CIL's website at the date of order or as agreed between the parties. The price is inclusive of VAT ( unless explicitly stated ) and exclusive of any delivery charges.
Payment of the total purchase price (including VAT and any delivery charges) must be made in full before dispatch of the Goods from CIL's premises.
CIL accept card payments via our secure payment service provider Netbanx. If you are shopping from outside the UK your card company will convert the transaction to your local currency. |
TaxFor orders made from the UK or the European Union, 17.5% VAT is added. All other orders are VAT free. |
Minimum Order SizeDue to the overheads of processing, the minimum order size we can accept is 10 negatives or 10 slides. Due to the design of our scanners the minimum negative strip length we can accept is - 2 negatives per strip. |
Order ProcessingPlease include copy of your order slip with your delivery of your media to us so we can easily track your order through our workflow. |
Image Processing Personalisation and Deliverable MediaImages ( other than the free scan offer ) will be delivered on DVD in JPG or TIFF, depending on your chosen options. Free scan offer images will be emailed.
We will do our best to ensure that the order of the negatives is maintained as per the original film ( or as received by us ), but we cannot guarantee this.
Processed image filenames will be sequential ( e.g. 001, 002 etc. ). We can put a personalised fixed prefix on each image exported to the DVD for example : -
2008-Sams-Wedding-
which would result in files named
2008-Sams-Wedding-001, 2008-Sams-Wedding-002 etc.
Please let us know which prefix you would like ( if any ) when ordering by specifying this via the additional services section.

Virus Scanning & MediaWe use good quality DVD media and check the media for viruses and that the media reads in our machines prior to leaving our premises. We also continuously check our secure IT infrastructure for viruses, trojans etc., but cannot be held liable for any resulting destructive results.
We cannot take responsibility for media failures after the media leaves our premises. However if the media is damaged in transit, please get in touch as soon as possible so that we can send you a replacement. We do not retain your images on our systems after your order is expected to have arrived (for your privacy) so damaged media needs to be notified as soon as possible.

Force MajeureCIL shall not be liable to the customer or be deemed to be in breach of the contract of sale for any delay in performing, or any failure to perform, any of CIL's obligations in relation to the goods if the delay or failure was due to any reason beyond CIL reasonable control. |
DeliveryDelivery of the Goods shall be made by CIL notifying the Buyer that the Goods have been shipped to such place and on such terms as agreed between the Seller and the Buyer at the time the order is placed.
All Goods, wherever possible, will be delivered within 5 working days of the order being placed ( or in the case of the personalised scanning of media, within 5 working days of the media to be scanned having been received by CIL).
CIL shall use its reasonable endeavours to meet any date stated for delivery. CIL shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date. Any dates provided for delivery are approximate only, and Celtic Intuition Limited is not responsible for the timely receipt of goods once dispatched to the customer. As such, late deliveries will not be refunded, and payment will be pursued due to the personalised nature of our products.
DVDs and other media not received within 7 working days of shipment from Celtic Intuition Limited must be reported to Celtic Intuition Limited by email or writing.
Title and risk in the Goods shall pass to the Buyer upon delivery of the Goods.
Shipping costs are calculated based on the weight of the media to be scanned.

For your complete piece of mind you may also appoint a courier to collect your media from our premises by prior arrangement and at your expense.
We will deliver your order as soon as we have finished scanning, processing, exporting and packaging your images. Once dispatched your order should be with you within 2 days for UK orders ( First Class ) or 5 days for overseas orders ( if Airsure is chosen ).
You must inform us within 7 working days from our confirmation of shipping to you if the goods are lost or damaged in transit so that we can make a prompt claim against the delivery company and correct the problem. Please quote your order number in all correspondence.
You agree that proof of delivery supplied by our delivery company ( or in the case of you appointing a courier, our receipt of shipping ) is sufficient evidence to establish that goods have been received / shipped.

CancellationNo goods are sold to the customer on a sale or return basis. The customer has no right to reject or return the goods without the consent of CIL. As goods are personalised a 'cooling off' period is not applicable. Your statutory rights are not affected.

Damaged GoodsDamaged goods must be reported to Celtic Intuition Limited within 48 hours of delivery receipt, by email, failure to do so and Celtic Intuition Limited will not accept responsibility and the customer shall not be entitled to reject the goods.

Limitation of LiabilityCeltic Intuition Limited (CIL) is not liable for the media or any other materials while in transit through or in possession of the Royal Mail or any other carrier. You the Consumer and Customer agree to be liable for any media or any other materials, should they be misdirected, lost, stolen, or damaged while in transit through Royal Mail, or any other carrier used for transport. When we return your media we will use only shipping methods that are reliable and traceable. All items purchased through CIL or the Service are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to your selected carrier. CIL offers no warranty or guarantee against damage or loss.
Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury, however the Seller shall not be liable for any direct loss or damage suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract or otherwise in excess of the price of the Goods.
CIL shall not be liable under any circumstances to the Buyer or any third party for any indirect or consequential loss of profit, consequential or other economic loss suffered by the Buyer howsoever caused, as a result of any negligence, breach of contract, misrepresentation or otherwise.
We would advise that you take out insurance to cover any loss of the media whilst away from your premises. Whilst your media is with us it will be handled with extreme care and will be kept in a secure area overnight whilst it with us.
We regret that we can only be liable for the cost of replacement of the image media ( i.e the purchase price of the film ) if they are lost at our premises after we receive the media and prior to shipment via your chosen return carrier and would advise that you insure/cover your media against loss in transit both to and from our premises. CIL cannot be held liable for loss of media whilst in transit.
If you wish to arrange your own carrier pickup of your media from our premises at your own expense then please state this on your order ( you can do this by choosing the "Customer own arrangements" shipping option at checkout time ). Celtic Intuition Limited will not be held liable for any losses in transit of your media by your carrier
If you choose to have your media returned via Royal Mail Special Delivery, you can add on their Consequential Loss product ( intended for difficult to replace items such as transparencies ) .

VariationCIL may vary, without any liability, the content of the site, including quotations, sales literature or other documents as long as such alterations do not materially affect the quality of the goods.

SeverenceIf any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated. |
